Beth N. Kibel
Beth N. Kibel is Counsel in the Firm’s New York Bankruptcy Practice at Smith, Gambrell & Russell, LLP.
Ms. Kibel practices in the area of business reorganization and financial restructuring law. She regularly represents chapter 11 debtors-in-possession, secured creditors, large institutional unsecured creditors, creditors’ committees, landlords, purchasers of estate assets, and other entities in complex bankruptcy reorganization proceedings, as well as out-of-court workouts and restructurings. Ms. Kibel has experience in all aspects of bankruptcy proceedings, including cash collateral matters, asset sales, debtor-in-possession financing, contract and lease assumptions and rejections, disclosure statement hearings, plan analysis and confirmation, automatic stay motions, preference and fraudulent conveyance actions, claims trading, and claims objections.
Ms. Kibel’s representations have encompassed a wide range of industries, including real estate and health care. For example, Ms. Kibel has represented secured creditors in numerous major health care cases, including In re: Sun Healthcare Group Inc., In re: Integrated Health Services, Inc., In re: Genesis Health Ventures, Inc., and In re: Mariner Healthcare Group, Inc. Ms. Kibel also has experience in creditors’ rights litigation and complex commercial litigation.
A member of the American Bankruptcy Institute and the International Woman’s Insolvency and Restructuring Confederation, Ms. Kibel is a 1992 graduate of the Syracuse University College of Law, where she was executive editor of the Journal of International Law and Commerce, and a graduate, with honors, of the University of Chicago. Ms. Kibel is admitted to practice in New York and New Jersey and before the U.S. District Court, Southern District of New York; U.S. District Court, Eastern District of New York; U.S. District Court, Northern District of New York; and the U.S. District Court, District of New Jersey.
