David A. Mobley
Mr. Mobley is an associate of Smith Gambrell & Russell’s Litigation Section and brings nearly 17 years of experience in the infrastructure development industry to his practice.
Banking Litigation
Mr. Mobley is principal member of the firm’s banking litigation team and routinely litigates tens of millions of dollars in disputes for lenders. He has handled various types of matters ranging from litigation involving promissory notes and commercial guarantees, to allegations of fraud and violations of other consumer protections laws asserted against lenders. He has also represented construction lenders on numerous disputes that have arisen during real estate acquisition and development projects, and with nearly 17 years of prior experience in the infrastructure development industry, he brings a unique perspective to this practice.
Complex Commercial Litigation
Mr. Mobley has been involved with various other types of commercial litigation throughout his legal career. Early in his career, he was involved in a protracted, bet-the-company litigation involving a highway construction firm litigating against a state department of transportation. As part of that litigation team, he was instrumental in helping the client to secure an exclusion of all of the state’s scientific evidence in two separate lawsuits under Georgia’s newly-enacted Daubert standards.
Mr. Mobley has also represented clients in trade secrets litigation, actions involving alleged breaches of consumer financing agreements, and various other commercial disputes. As part of his practice, Mr. Mobley routinely represents international clients that operate in the North American marketplace and is experienced at meeting the unique needs of these firms.
Mr. Mobley has also represented and advised clients on issues related to contracts with federal and state governments, including bid protests and disputes on government projects, evaluation of the risk associated with government contracting provisions, claims for additional compensation and requests for equitable adjustments submitted to agencies of the United States government, litigation with various government entities, and several matters involving the rules and regulations for minority and small business enterprises.
Infrastructure and Manufacturing
Prior to joining Smith Gambrell & Russell, Mr. Mobley worked in both the pipe manufacturing and the infrastructure development industries and has extensive experience representing clients involved in these industries. As a lawyer, he has assisted client to draft and negotiate construction, engineering and material purchase agreements throughout the United States, including an addition to one of the world’s largest aquariums, various manufacturing plants, power generation and federal government research facilities, international resort developments, and various types of commercial and retail facilities. Mr. Mobley’s litigation experience includes a multi-million dollar claim on a project for a state university infrastructure improvement, work for a client involving a dispute on a federal courthouse construction project, and various matters for an international provider of building automation products and services. He routinely advises clients on issues that arise during the bidding and negotiation phases of construction projects, and provides general counsel to clients on disputes that occur during the projects. He has also represented companies involved in the construction of conventional, nuclear and renewable energy power generation facilities, and his experience in the power generation sector includes both contract drafting and review for solar and nuclear power generation projects, and providing advice to project participants during disputes.
Other Professional Experience
Prior to joining Smith, Gambrell & Russell, Mr. Mobley held the position of Trial Attorney with the United States Department of Justice’s Antitrust Division. In that position, he was involved with the investigation and prosecution of various white-collar criminal violations in the manufacturing and construction industries, and took part in numerous grand jury investigations.
Education
Mr. Mobley received a Bachelor’s degree in Mechanical Engineering from Auburn University, and earned his J.D. degree, magna cum laude, from The University of Alabama.
Professional and Community Involvement
Throughout his career, Mr. Mobley has been active in local charitable organizations, including the High Museum of Art, serving on the Planning Committee, and as the co-chair for the High Museum’s Annual Wine Auction. Mr. Mobley also serves as a Board Member of the St. Thomas More Society, an organization of Catholic Lawyers. In 2008, he received the Archbishop Francis Donoghue Award for exemplary service to the St. Thomas More Society. Mr. Mobley has also served as an executive member of Georgia Appleseed’s Young Professional’s Council.
He is a member of both the Florida and Georgia bar associations.
